1. Introduction & Acceptance

SnapStream is an AI-powered photo matching and delivery service operated by Kale Kusch (Pty) Ltd, a company registered in the Republic of South Africa (“we”, “us”, “our”).

By sending agree via WhatsApp, you accept these Terms & Conditions in full. If you do not agree, do not use the Service.

These terms should be read together with our Privacy Policy.

2. Definitions

  • “Service” — the SnapStream photo matching and delivery platform, including the WhatsApp bot, photo gallery, and all related systems.
  • “Personal Information” — as defined in Section 1 of the Protection of Personal Information Act, 2013 (POPIA).
  • “Facial Recognition Data” — mathematical face vectors derived from your selfie, used solely for photo matching. These are not raw biometric images.
  • “Event” — the festival, concert, or occasion at which SnapStream provides photo matching services.

3. How the Service Works

  1. You join an Event by scanning a QR code or sending a join command via WhatsApp.
  2. You accept these Terms & Conditions by sending agree.
  3. You send a clear selfie of your face.
  4. We create a mathematical face vector from your selfie and use it to search Event photographs for your face.
  5. When we find a match, we notify you via WhatsApp and provide access to your personal photo gallery.

4. What Data We Collect

  • Your WhatsApp phone number (used as your unique identifier).
  • Your name (as provided by your WhatsApp profile).
  • A selfie photograph you send us.
  • Facial recognition vectors — mathematical representations derived from your selfie. These are not raw biometric images.
  • Records of photos in which your face was matched.

5. How We Use Your Data

We use your data exclusively to:

  • Create a facial recognition vector from your selfie for photo matching.
  • Search Event photographs for your face and notify you of matches.
  • Provide you with a personal photo gallery via a time-limited link.
  • Send you WhatsApp messages about your photo matches.

We do not use your data for marketing, sell it to third parties, or use it for any purpose beyond photo matching and delivery.

6. Facial Recognition Technology

We use Amazon Web Services (AWS) Rekognition to create mathematical face vectors from your selfie. Only these vectors are stored in the recognition system — not the raw biometric image data.

Face vectors are used solely to match your face against Event photographs. Your selfie image is stored temporarily and deleted in accordance with our data retention policy.

7. Data Retention & Deletion

  • All personal data — including facial recognition vectors, selfie images, and photo match records — is automatically deleted 30 days after the Event concludes.
  • Gallery access links expire after 7 days.

You may request immediate deletion of all your data at any time by sending delete via WhatsApp. This removes your account record, selfie image, facial recognition data, and all photo match records.

8. Photo Gallery Access

You can view your matched photos via a personal gallery link sent to you on WhatsApp. Gallery links contain a time-limited access token that expires after 7 days.

Photos displayed in the gallery may include watermarks. Download and use of Event photos may be subject to additional terms set by the Event organiser.

9. WhatsApp Messaging

By using this Service, you consent to receive messages via WhatsApp relating to: registration confirmations, photo match notifications, and gallery access links.

Message frequency depends on how many photos of you are found during the Event. You can stop all messages and delete your account by sending delete.

10. Third-Party Services

We use the following third-party service providers to operate SnapStream:

  • Amazon Web Services (AWS) Rekognition — facial recognition processing.
  • Amazon Web Services (AWS) S3 — photo and data storage.
  • Twilio — WhatsApp message delivery.

These services process your data under their own privacy and security policies.

11. Age Restriction

This Service is intended for persons aged 18 or older. If you are under 18, you must have parental or guardian consent before using this Service.

12. Limitation of Liability

The Service is provided “as is”. We do not guarantee that all photographs of you will be identified or that notifications will be delivered without delay.

To the fullest extent permitted by South African law, Kale Kusch (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

13. Changes to These Terms

We may update these Terms & Conditions from time to time. Updated terms will be posted at this URL. Continued use of the Service after changes constitutes acceptance of the revised terms.

14. Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the jurisdiction of the South African courts.
